Employment discrimination and the law
If you’re looking for a job, or if you already have one, there may be laws in place that make it illegal for an employer to discriminate against you. Examples of employment discrimination based on disability could include:
- failing to hire
- failing to promote
- other unfair treatment
- harassment
- denying a reasonable accommodation
- firing
It is illegal for an employer to discriminate against you based on your:
- disability,
- race,
- color,
- religion,
- sex,
- national origin,
- age (40 or older), or
- genetic information.
It is also illegal for an employer to retaliate against you because you complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit.
How to file a charge
If you believe you have been discriminated against by an employer – and the employer has 15 or more employees – you can file a charge of employment discrimination with the U.S. Equal Employment Opportunity Commission (EEOC) and the Texas Workforce Commission Civil Rights Division (TWCCRD).
Our Employment Discrimination Charge Tool makes it easy for you to file a charge of discrimination with both the EEOC and TWCCRD. With the tool, you just fill out our online form and you get a completed EEOC Form 5: Charge of Discrimination and a cover letter that you send directly to the EEOC. Your EEOC Form 5 will also have Texas-specific information, so when you send it to the EEOC, it was also be filed with TWCCRD.
Texas and other states: This tool is designed to be used if your employer is a Texas company, if you are complaining about employer decisions that were made in Texas, or if you worked for your employer in Texas.
