Statement on 5th Circuit Court decision on stay in mask mandate ban lawsuit

USCA Order: Attorney General Paxton’s emergency motion is GRANTED, and the district court’s injunction prohibiting the enforcement of GA-38 in Texas public schools is hereby STAYED pending appeal. (lt)

“We are disappointed by the 5th Circuit’s decision allowing Texas to continue enforcing the ban on mask mandates for the time being. Our suit has always been about allowing students with disabilities at high risk of COVID to attend schools in person as safely as possible. As new COVID variants threaten to make an improving situation worse again, it is imperative schools have the option of requiring masks in the class, campus or district as needed to protect vulnerable students. We look forward to making our case on the merits and are hopeful the decision at that time will be more favorable.”
