People with mental health conditions are often among the most vulnerable in society. Many may not be able to advocate for themselves due to the nature of their condition or the facility where they are receiving care.
In the past, some people with mental illness experienced abuse and neglect in places like psychiatric institutions, but there was very little accountability or oversight. So Congress stepped in and passed the Protection and Advocacy for Individuals with Mental Illness (PAIMI) Act, a landmark federal law to safeguard the rights of people with mental health conditions.
The PAIMI Act gives organizations like Disability Rights Texas the authority to investigate abuse and neglect, monitor facilities, and stand up for people’s rights. This means we can go into facilities, review records (with consent), and take action when something isn’t right. Just as important, we help people understand their rights and speak up for themselves.
May is Mental Health Awareness Month and this May is the 40th anniversary of the PAIMI Act. Even though mental health has been in the public consciousness for decades, the need for this work hasn’t gone away. As mental health systems face growing demand, strong advocacy and oversight matter more than ever.
